These Affiliate Program Terms ("Affiliate Terms") govern every person or entity ("Affiliate," "you") who promotes, advertises, links to, or refers customers to any product of Digital ATM System ("Company," "we") in exchange for a commission, whether through JVZoo, any other affiliate network, or a direct arrangement. By requesting an affiliate link, accepting an affiliate approval, or promoting any Company product, you agree to these Affiliate Terms. If you do not agree, do not promote our products.
1. Independent Contractor; No Authority
You are an independent contractor. Nothing in these Affiliate Terms creates an employment, agency, partnership, or joint-venture relationship. You have no authority to make any promise, representation, warranty, or guarantee on the Company's behalf, to bind the Company in any way, or to modify any Company offer, price, refund policy, or guarantee. The only authorized product claims are those published by the Company on its own websites and in approved promotional materials we supply.
2. Truthful Advertising; Approved Claims Only
You must not, in any promotion of our products:
- Make any income, earnings, or results claim that does not appear in our approved promotional materials — including any specific dollar amount, timeframe, or lifestyle outcome
- State or imply that income is guaranteed, typical, easy, fast, or automatic
- Fabricate testimonials, reviews, screenshots, news articles, or endorsements, or use anyone's likeness without documented consent
- Misrepresent what the product is, what it includes, its price, its refund terms, or your relationship to the Company
- Impersonate the Company, its founder or personas, or any customer
- Use "fake news," fake scarcity, fake countdown timers, or any other deceptive format
3. Required Disclosures
You must clearly and conspicuously disclose your material connection to the Company (that you earn a commission on referred sales) in every promotion, placed before the recommendation and unavoidable by an ordinary reader, in compliance with the FTC's Endorsement Guides (16 C.F.R. Part 255) and any equivalent law of the jurisdictions you target. Where our approved materials include earnings disclaimers or typicality qualifiers, you must reproduce them intact and unmodified.
4. Traffic and Conduct Rules
You must not:
- Send email that violates CAN-SPAM or applicable anti-spam law, or send any commercial email to lists without documented, lawful consent
- Place calls or texts that violate the TCPA, state telemarketing laws, or do-not-call rules
- Bid on Company trademarks or brand terms in paid search, or use them in domains, handles, or app names, without written permission
- Use cookie stuffing, forced clicks, iframes, typosquatting, incentivized fraud, bot traffic, or any technique that fakes a referral
- Promote through content or placements that are illegal, hateful, adult, or deceptive
- Buy through your own affiliate link or manufacture transactions
5. Monitoring, Enforcement, and Termination
We monitor affiliate promotions, investigate reports sent to support@digitalatmapp.com, and act on violations. We may, at our sole discretion and without notice: require immediate correction or removal of any promotion; withhold or claw back commissions on sales generated through violating promotions; suspend or terminate your affiliate approval; and report violations to the applicable affiliate network. Termination does not relieve you of obligations that by their nature survive, including Sections 6 and 7.
6. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, agents, and affiliates from and against any and all claims, actions, investigations, demands, damages, penalties, fines, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your promotions, advertisements, statements, or content; (b) your violation of these Affiliate Terms or any law or regulation, including the FTC Act, the TCPA, CAN-SPAM, and state consumer-protection and telemarketing laws; (c) any unauthorized claim or representation you make about any Company product; and (d) any data you collect or use in your promotions. This obligation survives termination of your participation.
7. Records and Cooperation
You must keep records of your promotions (including copies of ads, emails, landing pages, and consent records for any list you mail or message) for at least two (2) years, and provide them to us within five (5) business days of request. You agree to cooperate fully with any Company compliance review and with any regulator inquiry relating to your promotions.
8. Commissions
Commission rates, cookie terms, and payment mechanics are set by the applicable affiliate network (e.g., JVZoo) or by a separate written agreement with us, and may be changed prospectively at any time. Commissions are not owed on refunded, charged-back, fraudulent, or violating transactions.
9. General
These Affiliate Terms are governed by the laws of the State of Wyoming. Any dispute between you and the Company relating to the affiliate program shall be resolved through binding individual arbitration on the terms set out in Section 12 of our Terms of Service, applied to you as an Affiliate. We may update these Affiliate Terms at any time by posting the updated version at this URL; continued promotion after posting constitutes acceptance. Questions: support@digitalatmapp.com.
