In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. Section 512, we will respond promptly to claims of copyright infringement committed using our Site or Services.

1. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible on our Site or through our Services in a way that constitutes copyright infringement, please provide our Designated DMCA Agent with a written notification containing the following information (as required by 17 U.S.C. 3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL where the material is found)
  4. Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

2. DMCA Designated Agent

Please send all DMCA notices to:

Email: dmca@digitalatmsystem.com

Important: Only DMCA notices should be sent to the Designated Agent. Any other feedback, comments, requests for technical support, or other communications should be directed to support@digitalatmsystem.com.

3. Counter-Notification

If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent containing the following:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside of the United States, for any judicial district in which the Company may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action seeking a restraining order against the content provider within 10-14 business days, we will restore the removed material.

4. Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, in our sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Misrepresentation Warning

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Before filing a DMCA notice or counter-notification, you may wish to consult an attorney to understand your rights and obligations.
